Terms of Service

By accessing or using endrow (the "Platform"), located at endrow.farm, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. Your continued use of endrow after any modifications to these Terms constitutes acceptance of those modifications.

endrow is operated in the United States and is intended for use by individuals and farming operations located in the United States.

To use certain features of endrow, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years of age to create an account. If you are creating an account on behalf of a farming operation or business entity, you represent that you have the authority to bind that entity to these Terms.

You agree to notify endrow immediately at hello@endrow.farm if you become aware of any unauthorized use of your account.

endrow offers the following subscription tiers:

• Free — Basic access to market data and limited features at no cost.
• Grower ($35/month) — Full market intelligence, AI market briefs, contract tracking, cost management tools, and document upload capabilities.
• Family ($69/month) — Everything in Grower, plus family knowledge preservation (365 daily questions), multi-user access for family members, and shared family tools.

Standard paid subscriptions include a 30-day free trial. Certain referral or advisor invitation programs may extend that trial window to 45 days, and if a longer trial is shown during signup that longer window controls. During the trial period, you will have full access to the features of your chosen plan at no charge. Your payment method will not be charged until the trial period ends. You may cancel at any time during the trial without being charged.

After the trial period, your subscription will automatically renew on a monthly basis at the applicable rate unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time within a billing cycle.

endrow reserves the right to change subscription pricing with advance notice to existing subscribers. Price changes will take effect at the start of a later billing cycle after that notice.

You may submit, upload, or input various types of content into endrow, including but not limited to: farm profile information, grain contracts, cost data, family knowledge responses, photographs of elevator tickets and receipts, equipment records, and other documents ("User Content").

You retain full ownership of all User Content you submit to endrow. By submitting User Content, you grant endrow a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the Platform's services to you. This license terminates when you delete your User Content or your account. If you opt into our Regional Benchmark Network, you additionally grant endrow a perpetual, irrevocable, non-exclusive license to use de-identified, aggregated derivatives of your contributed data to build and improve regional benchmarks inside endrow. This license applies only to benchmark derivatives designed not to include direct identifiers and survives termination of your account.

You represent and warrant that you have the right to submit all User Content and that your User Content does not violate any applicable law or infringe upon the rights of any third party.

endrow and its licensors own all rights, title, and interest in and to the Platform, including all software, algorithms, user interface designs, trademarks, service marks, and all related intellectual property. These Terms do not grant you any right to use the endrow name, logos, or trademarks without prior written consent.

You own your data. endrow does not claim ownership over any User Content. The AI-generated analysis, briefs, recommendations, and other outputs produced by the Platform based on your data are provided for your use, but the underlying models, algorithms, and technology remain the property of endrow and its licensors.

endrow provides market data, analytical tools, AI-generated briefs, and algorithmic indicators (including "HOLD," "SELL," and "BUY" signals) strictly for INFORMATIONAL PURPOSES ONLY. endrow is not a registered investment advisor, commodity trading advisor, broker-dealer, or financial planner under any federal or state securities, commodities, or financial planning laws.

Nothing on this Platform constitutes financial advice, investment advice, commodity trading advice, or any form of personalized recommendation. The "HOLD," "SELL," and "BUY" indicators displayed on the Platform are the output of algorithmic analysis of market conditions, publicly available data, and statistical models. They are not tailored to your individual financial situation, risk tolerance, marketing goals, or circumstances.

You acknowledge and agree that:

• All grain marketing decisions are made solely by you, at your own risk.
• endrow's analytical outputs may be inaccurate, delayed, or incomplete.
• Past performance of any indicator or model does not guarantee future results.
• You should consult with a qualified commodity broker, financial advisor, or farm management consultant before making significant marketing decisions.
• Grain marketing involves substantial risk of loss, and the value of grain can decline significantly.

Your data is stored on infrastructure operated through Supabase (AWS) in the United States. Data in our managed infrastructure is encrypted at rest, and data sent between your device and endrow uses TLS 1.3. For full details on our data practices, see our Privacy Policy.

You have the right to:

• Access much of your account and farm data through the product.
• Request an export of your data in a portable format.
• Request correction of inaccurate data.
• Start account deletion through your account settings.

Upon account deletion, your account data is scheduled for removal from active systems within 30 days, subject to the limited retention items described in our Privacy Policy.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ENDROW, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR DAMAGES ARISING FROM GRAIN MARKETING DECISIONS MADE IN RELIANCE ON INFORMATION PROVIDED BY THE PLATFORM.

ENDROW'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO ENDROW IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

endrow is not liable for any losses, damages, or costs incurred as a result of marketing decisions, whether or not those decisions were informed by data, analysis, or recommendations provided by the Platform. You use the Platform's market intelligence features at your own risk.

You agree to indemnify, defend, and hold harmless endrow and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) your User Content.

You may terminate your account at any time by using the account deletion feature in your settings or by contacting hello@endrow.farm. Upon termination, your right to use the Platform ceases immediately, and your data will be deleted in accordance with our data retention policy.

endrow reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that endrow determines, in its sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable. Grounds for suspension or termination include, but are not limited to: abuse of the Platform, automated scraping or data extraction, attempts to reverse-engineer Platform algorithms, sharing account credentials, or using the Platform for any unlawful purpose.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ENDROW DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

endrow does not warrant the accuracy, completeness, or timeliness of any market data, price information, AI-generated content, or analytical outputs provided through the Platform. Market data may be delayed by 15 minutes or more and may contain errors.

These Terms shall be governed by and construed in accordance with the laws of the State of South Dakota, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Platform shall be resolved exclusively in the state or federal courts located in South Dakota, and you consent to the personal jurisdiction of such courts.

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting endrow at hello@endrow.farm. endrow will attempt to resolve the dispute informally within 30 days of receiving your notice.

endrow reserves the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes by posting the updated Terms on the Platform and, where possible, by sending notice to the email address associated with your account. Your continued use of the Platform after the effective date of any modifications constitutes your acceptance of the modified Terms.

If you do not agree to the modified Terms, you must stop using the Platform and may delete your account.

Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

Entire Agreement. These Terms, together with the Privacy Policy, Cookie Policy, Disclosures, and the Regional Benchmark Network terms shown in the Data Sharing section of your account settings, constitute the entire agreement between you and endrow regarding the use of the Platform.

Waiver. The failure of endrow to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment. You may not assign or transfer your rights under these Terms without endrow's prior written consent. endrow may assign its rights and obligations under these Terms without restriction.
